Following a complaint from a blind Oklahoma resident, the department investigated Service Oklahoma's predecessor entity. In November 2023, the department issued a letter of findings stating that the Oklahoma Mobile ID Application creates significant accessibility barriers for individuals with vision disabilities.
The Justice Department made an important announcement today regarding a settlement agreement with Service Oklahoma, a state agency. This agreement aims to address the agency's violation of Title II of the Americans with Disabilities Act (ADA) by maintaining a mobile application that is not accessible to individuals with disabilities.
“When public entities make services available through mobile apps, they may not exclude people with disabilities by failing to make their technology accessible,” said Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division. “Through this agreement, Service Oklahoma will ensure their mobile apps comply with the ADA by removing barriers that prevent Oklahomans with disabilities from accessing public services. As more state and local governments turn to mobile apps for critical public services, the Justice Department will work to ensure that people with disabilities are guaranteed the ADA’s promise of equal access.”
The department conducted an investigation into Service Oklahoma's predecessor entity after receiving a complaint from a blind resident of Oklahoma. The complaint alleged that the Oklahoma Mobile ID Application is not accessible to individuals with vision disabilities. In November 2023, the department issued a letter of findings, concluding that the mobile app creates significant barriers for people with vision disabilities. It was determined that Service Oklahoma violates the ADA by denying equal access to the mobile app for people with disabilities and by failing to ensure effective communication with them, as it does with others.
As part of the Civil Rights Division's Tech Equity Initiative, this settlement agreement aims to combat disability discrimination that arises from the use of technology, including websites and mobile apps. Service Oklahoma has committed to ensuring that any mobile app it creates, administers, or maintains is accessible to individuals with disabilities and adheres to the Web Content Accessibility Guidelines (WCAG), Version 2.1, Level AA.
In addition, Service Oklahoma will implement other corrective measures, such as actively seeking accessibility feedback and requests from the public, appointing an ADA coordinator, providing ADA training to employees, and regularly reporting to the department. This agreement reflects our dedication to promoting equal access and inclusivity for all individuals.
