A retired Boston Police officer received his sentence yesterday as part of a probe into overtime fraud at the Boston Police Department's evidence warehouse’. Thomas Nee, aged 67 and residing in Yarmouth, was handed a two-year supervised release by U.S. District Court Judge Richard G. Stearns.
Additionally, Nee was instructed to pay a $2,000 fine and $16,151 in restitution. Last November, Nee admitted guilt to a charge of conspiracy to commit theft related to programs funded by the federal government and a charge of embezzlement from an agency funded by federal resources.
During the period spanning from February 2015 to February 2018, Nee consistently submitted falsified overtime slips for shifts at the evidence warehouse that he never actually worked. The "purge" overtime shift, scheduled from 4 to 8 p.m. on weekdays, was designated for the disposal of outdated evidence. Additionally, the "kiosk" overtime involved visiting each police district in Boston once a month to collect expired prescription drugs for incineration.

Similarly, for the "kiosk" shift, Nee submitted overtime slips indicating he worked eight-and-a-half hours, when in reality he only put in three to four hours during those shifts.
Between February 2015 and February 2018, Nee personally collected approximately $16,151 for overtime hours he did not work.
Nee was one of 15 police officers charged in connection with committing overtime fraud at the Boston Police Department’s evidence warehouse, 10 of whom have been convicted either by guilty plea or jury verdict. Of the remaining officers charged, four were acquitted in April 2023 and one officer passed away while charges were pending. Nee is the fourth defendant to be sentenced in the case
Between 2015 and 2019, the BPD received yearly benefits exceeding $10,000 from both the U.S. Department of Transportation and the U.S. Department of Justice. These benefits were provided through various federal grants.
